Kant nimmt in der Einleitung zur Metaphysik der Sitten eine Einteilung in innere und äußere Gesetzgebung vor. Beide leitet er aus demselben in der Grundlegung zur Metaphysik der Sitten formulierten kategorischen Imperativ ab, und fügt Letzterem weitere Elemente einer Grundanthropologie hinzu, die das Material für die einzelnen Teile der Rechts- und Tugendlehre darstellen. Die Zusammenhänge zwischen Rechts- und Tugendlehre sind aber komplexer als die Einteilung in äußere und innere Gesetzgebung es nahelegt. Sie teilen etwa dieselben Anwendungsmethoden und Metaphern, und bei (...) einer näheren Untersuchung der einzelnen Teile erweist sich diese Einteilung als entweder problematisch oder unscharf. In der Textinterpretation der einzelnen Beiträge kommen die genannten Zusammenhänge und Beziehungen zum Vorschein – insbesondere weil ein Teil der Autoren dieses Bandes zum Kommentar beider Werken beiträgt. Ein weiterer Schwerpunkt dieser Textinterpretationen liegt bei der kritischen Untersuchung des Ertrags dieser Werke für die entsprechenden heutigen Debatten und die Auseinandersetzung mit heutigen im weiten Sinne „Kantischen“ Positionen. In diesem Beitrag werden die Fragen diskutiert: Welche Vorstellungen von Geschlecht und Sexualität finden sich im Buddhismus, welche Frauenrollen oder Frauenbilder lassen sich daraus ableiten, und was geschieht, wenn diese Geschlechtervorstellungen heute auf den europäischen Kontext treffen: Welche Probleme entstehen? Ist Geschlechtergerechtigkeit ein westliches Problem oder wird sie weltweit thematisiert? Lassen sich Wechselwirkungen feststellen, und welche Strategien werden verfolgt, um Geschlechtergerechtigkeit im Buddhismus herzustellen?

Simulationen mit Simulationspersonen gehören in der medizinischen Lehre zum Ausbildungs-Standard. In der medizinethischen Lehre ist dies bisher nicht in gleichem Umfang der Fall. Für ihren Einsatz, insbesondere in der klinischen Ethik, können gute Gründe angeführt werden, wie beispielsweise die Möglichkeit konkreter Erfahrungen als Lehrelement und die situationsspezifische Verbindung von Wissen, Können und Haltungen in einem Lernprozess. Die Konzeption von Simulationen mit Simulationspersonen in der medizinethischen Lehre ist jedoch voraussetzungsreich. Es müssen die mehrdimensionalen Lernziele und die Anforderungen an die medizinethische Lehre (...) berücksichtigt werden. Der Beitrag möchte anhand eines konkreten Beispiels einen Überblick über die Entwicklung und Konzeption von Drehbüchern bzw. Rollen-Skripten für Simulationen mit Simulationspersonen für die Lehre in der klinischen Ethik als wichtigem Teilbereich der Medizinethik geben. Dabei wird auf die besonderen Voraussetzungen und Spezifika dieser Simulationen eingegangen. Abschließend wird kritisch diskutiert, welchen Stellenwert das Training von kommunikativen Fertigkeiten in der medizinethischen Theorie und klinisch-ethischen Praxis haben kann und soll. Der Beitrag schließt mit der Überlegung, ob nicht auch in der Fortbildung von klinischen Ethiker*innen Simulationspersonen zum Einsatz kommen sollten. (shrink)

Zusammenfassung Patientinnen und Patienten steht das Recht auf Behandlung nach ihren eigenen Vorstellungen auch dann zu, wenn sie aktuell keinen eigenen Willen bilden können. Advance Care Planning (ACP), als ein spezielles Verfahren der gesundheitlichen Vorsorgeplanung, zielt darauf ab, dieses Dilemma durch eine Willensbestimmung im Voraus aufzulösen. Besonders ausgebildete Gesprächsbegleiter*innen bieten an, bei der Ermittlung, Formulierung und Dokumentation eines solchen, die individuelle gesundheitliche Situation berücksichtigenden Willens zu helfen. Das Umfeld der Betroffenen soll in den Gesprächsprozess einbezogen und es soll organisatorisch gesichert (...) werden, dass deren Willensbestimmung den aktuell Behandelnden im Bedarfsfall faktisch zugänglich ist. Das Verfahren kombiniert also ein kommunikatives mit einem institutionellen Element. Aus ethischer Sicht stellen sich dabei zwei wesentliche Herausforderungen. Erstens erfordert Gesprächsbegleitung mit einem so komplexen Ziel Kompetenzen und setzt bestimmte Haltungen voraus, wie sie für Professionen im strengen Sinne typisch sind. Daher wäre es wichtig, entsprechende professionelle Normen explizit zu machen, beispielsweise in Form eines Berufs-Kodex. Zweitens muss das Verfahren trotz seiner institutionellen Form für die Betroffenen freiwillig sein. Dies ist entscheidend für die Validität des Prozesses, aber auch für dessen Ergebnis. Denn wenn Letzteres rechtlich bindend sein soll, müssen die Betroffenen freiverantwortlich, d. h. ohne sog. Willensmängel handeln können. Es ist deshalb ethische Pflicht, beim Eintritt in und im Verlauf der Beratung auf die Freiwilligkeit zu achten. (shrink)

BackgroundBiobanking biospecimens and consent are common practice in paediatric research. We need to explore children and young people’s (CYP) knowledge and perspectives around the use of and consent to biobanking. This will ensure meaningful informed consent can be obtained and improve current consent procedures.MethodsWe designed a survey, in co-production with CYP, collecting demographic data, views on biobanking, and consent using three scenarios: 1) prospective consent, 2) deferred consent, and 3) reconsent and assent at age of capacity. The survey was disseminated (...) via the Young Person’s Advisory Group North England (YPAGne) and participating CYP’s secondary schools. Data were analysed using a qualitative thematic approach by three independent reviewers (including CYP) to identify common themes. Data triangulation occurred independently by a fourth reviewer.ResultsOne hundred two CYP completed the survey. Most were between 16–18 years (63.7%, N = 65) and female (66.7%, N = 68). 72.3% had no prior knowledge of biobanking (N = 73).Acceptability of prospective consent for biobanking was high (91.2%, N = 93) with common themes: ‘altruism’, ‘potential benefits outweigh individual risk’, 'frugality', and ‘(in)convenience’.Deferred consent was also deemed acceptable in the large majority (84.3%, N = 86), with common themes: ‘altruism’, ‘body integrity’ and ‘sample frugality’. 76.5% preferred to reconsent when cognitively mature enough to give assent (N = 78), even if parental consent was previously in place. 79.2% wanted to be informed if their biobanked biospecimen is reused (N = 80).ConclusionProspective and deferred consent acceptability for biobanking is high among CYP in the UK. Altruism, frugality, body integrity, and privacy are the most important themes. Clear communication and justification are paramount to obtain consent. Background: Engaging in end-of-life care considerations is beneficial when the time is right. The purpose of this study is to provide a valid instrument to assess peoples readiness for end-of-life conversations before they are initiated.Materials and Methods: A community sample was recruited in study one for exploratory factor analysis of a 13-item questionnaire. In study two, psychometric properties were analyzed with structural equation modeling in a population affected by cancer. Convergent and discriminant validity were assessed with questionnaires measuring distress, depression, (...) anxiety, fear of progression, and distress of death and dying.Results: In study one exploratory factor analysis resulted in three subscales readiness, communication, and values with a possible common factor for a community sample. In study two the three-factor solution with 13 items was not supported for cancer patients. Factor structure was adapted to 12 items with one common factor readiness. Model fit was good: χ2 = 59.18, p>0.05, with χ2/df = 1.184, rRMSEA = 0.053, and rSRMR = 0.072. Convergent validity was supported by moderate correlations to trait gratitude, ratings of readiness to provide a living will or talk with family about the end of life. Divergent validity was supported by no or small correlation with distress, depression, general and death anxiety and fear of progression, respectively.Conclusions: Results support usage of the REOLC Scale in different settings with adapted factor structure. The questionnaire is interpreted as valid and reliable instrument to assess objective readiness for end-of-life conversations. (shrink)

Menschen aus unterschiedlichen Berufen, Patient*innen, An- und Zugehörige sowie ethisch Interessierte haben im Ethik-Café die Möglichkeit, aus ihrer persönlichen und beruflichen Perspektive ethische Fragestellungen zu diskutieren, die für ihren Alltag relevant sind. In his essay on Seneca, T.S. Eliot used theHercules Furens(=HF) as his example to illustrate ‘this curious freak of non-theatrical drama’. Even though Senecan scholarship has by and large moved away from his indictment, the sense that the attention seems to be directed away from the stage points to the play's unique dramaturgy. The surest indicator of this reverse orientation is the conspicuous absence of Hercules himself for much of the play. Hercules is (or wishes to be) permanently ‘elsewhere’. His (...) entrance is delayed for a long time; once home, he rushes offstage after a few lines to kill Lycus. He returns onstage only to be attacked by madness, and is drawn inside the palace again to kill his wife and sons. When his madness abates, he falls asleep onstage; on waking, he longs for a place beyond the known world (and underworld) and finally exits into exile. This article proposes a closer examination of the semiotics of space, especially the symbolic value of the offstage. Seneca is constantly drawing attention to the pull towards the stage perimeter and the unseen offstage, characterizing the cosmic nature of Hercules’ conflict with Juno and questioning the hero's place in the world as the son of an immortal father. This article argues that shareholder primacy cannot be defended on the grounds that there is something special about the position of shareholders that grounds a right to preferential treatment on part of management. The notions of property and contract, traditionally thought to ground such a right, are now widely recognized as incapable of playing that role. This leaves shareholder theorists with two options. They can either abandon the project of arguing for their view on broadly deontological grounds and try to (...) advance consequentialist arguments instead, or they can search for other morally relevant properties that could ground shareholder rights. The most sustained argument in the latter vein is Marcoux’s attempt to show that the vulnerability of shareholders mandates that managers are their fiduciaries. I show that this argument leads to the unacceptable conclusion that it would be unethical for corporations to make incomplete contracts with nonshareholding stakeholders. (shrink)

Umso erstaunlicher ist es, dass er dem Theoriekapitel der Traumdeutung einen Text voranstellte, der sich, entgegen seiner Absicht, auch als Alptraum lesen lässt: den sog. »Traum vom brennenden Kind«. In diesem Text sind Traum und Erzählung so untrennbar verbunden, dass er sich narrativen Genres wie dem Märchen und dem Exemplum annähert. Tatsächlich weist er, was bisher nicht gesehen wurde, starke Bezüge zu (...) dem Grimm’schen Märchen vom »Totenhemdchen« auf. Der vorliegende Beitrag unternimmt eine vergleichende Lektüre des atypischen Traums und des atypischen Märchens. Sie erlaubt, psychologische Fragen zu adressieren, die sowohl traum- als auch literaturtheoretisch relevant sind: die Frage nach dem Verhältnis von Wunscherfüllung und Angstausdruck und die Frage nach elementaren symbolischen Verfahren, die einem traumatischen Verlust an »Traumhaftigkeit« entgegenarbeiten. The essay departs from a detailed discussion of Jakobson’s description of the »poetic function.« It comes to the conclusion that the distinctive feature of poetic language, defined by Jakobson as the production of paradigmatic similarity, cannot be understood as a result of the projection of the paradigmatic axis of language onto its syntagmatic axis. Furthermore, the semantic effect of these similarities does not consist exclusively in a production of ambivalence; frequently, they produce coherence, as can be shown with reference to (...) examples of metaphors, metonymies and allegories. In a second step, the essay turns to a detailed interpretation of the 8th sonnet of Petrarch’s Canzoniere, which examines its intertextual relations to other son- nets of this cycle as well as those to scholastic theology and Platonic philosophy. This interpretation further develops the idea that poetic language produces coherence; for, precisely those lines that at first seem incomprehensible can be understood as implicit propositions and coherencecreating statements. In its concluding section, the paper characterizes the implicit production of coherence as the specific feature of poetic language and discusses the necessity of a hermeneutics of literary texts. In the following, I will discuss the current social reaction to the ecological crisis and the ways in which society reacts to technological risks, which can be understood primarily as a reaction to scientific and moral or ethical uncertainty. In the first section, I will clarify what is meant by scientific and moral or ethical uncertainty. In the second section, I will contrast Max Weber's differentiation of science, law [Recht) and morality in the modern world with the process of de-differentiation (...) of these value spheres, a trend which can be observed in the present-day context of the ecological crisis and technological risks. We shall see that social contradictions emerge in the functional relationships between these value spheres, and that such contradictions go hand in hand with these value spheres or contexts of discourse either losing their original function or becoming transformed. Science forfeits its role as a functional authority and becomes a strategic resource for politics. Law becomes a basic constituent of an amoral form of negotiation, which can no longer be properly grasped in terms of legal categories. Morality is transformed into fear, and economics yields unprofitable practices. In the third section, I will in attempt to open up the moral and ethical dimension of how to deal with uncertainty with the help of discourse theory, as well as outline a possible solution. (shrink)
